A Unitary Patent covers all participating EU states automatically with a single renewal fee, offering the most cost-effective route for broad European coverage. The PCT (Patent Cooperation Treaty) route provides a mechanism for deferring national phase entry decisions, giving applicants up to 30 months from priority to decide which jurisdictions to enter.

For defendants, it creates the risk of centralised invalidity proceedings that can revoke a patent across all participating states simultaneously.

The opt-out decision (whether to keep existing European patents under national court jurisdiction during the transitional period) is one of the most strategically important patent management questions for any company with a European portfolio.
