For staff who operate high-risk AI systems and make or influence decisions based on their outputs, AI literacy includes understanding how the system works at a sufficient level to identify anomalous outputs, understanding the system's limitations and failure modes, knowing how to engage the human oversight mechanisms, and understanding when to escalate concerns about a system's performance or output. For management responsible for AI governance and compliance decisions, AI literacy means understanding the regulatory framework, the risk classification of deployed systems, and the obligations that attach to each. For technical staff developing or configuring AI systems, it means understanding both the technical requirements of the Act and the design choices that affect compliance.
The AI literacy obligation is being systematically underestimated in compliance programmes for three reasons. First, it is less visible than the high-risk AI obligations: it does not feature in the Act's major headlines about conformity assessments and prohibited practices. Second, it requires ongoing investment in people rather than a one-time documentation exercise, which makes it harder to treat as a compliance checkbox. Third, its requirements are contextual and graduated, which means there is no off-the-shelf solution. Every organisation's AI literacy programme must be calibrated to its specific AI portfolio and workforce.
The commercial and operational consequences of inadequate AI literacy go beyond regulatory exposure. Organisations whose staff do not understand the AI systems they work with make worse decisions: they over-rely on AI outputs without recognising their limitations, fail to identify when a system is producing biased or erroneous results, and miss the signals that should trigger human override or system review. AI literacy is not just a compliance requirement; it is a precondition for getting value from AI deployment while managing the operational and reputational risks that poorly understood AI creates.
An effective AI literacy programme has four components. First, a literacy audit: mapping the organisation's AI systems against the staff roles that interact with them, identifying the competency requirements for each role, and assessing current literacy levels against those requirements. Second, role-specific training: designing or sourcing training content that addresses the specific knowledge gaps identified in the audit, calibrated to each role category (technical staff, operational staff, management, governance functions). Third, documentation: maintaining records of the literacy measures taken, the training provided, and the assessed competency levels. The AI Act requires this to be demonstrable. Fourth, ongoing review: AI systems and their use evolve, and literacy programmes must be updated when systems change, when new systems are deployed, and when the regulatory framework develops.

Failure to take adequate measures to ensure AI literacy is a violation of Article 4 of the AI Act. As a violation of a provision other than the prohibited practices, it is subject to fines of up to EUR 15 million or 3% of global annual turnover, whichever is higher. In practice, regulatory enforcement of the literacy obligation is likely to focus on systemic failure (organisations with no literacy programme and no documented measures) rather than on marginal deficiencies in training content. But the absence of any documented programme is a clear compliance gap.

Both require staff to understand how AI systems process personal data, what automated decision-making means, and how to handle data subject requests. A combined AI literacy and data protection training programme can address both frameworks' requirements simultaneously, while ensuring that staff understand how the AI Act and GDPR interact in practice rather than treating them as separate bodies of rules.
